One Killed in Head-On Crash With Semi on Highway 97 in Klamath County, OR

Klamath County, OR (April 13, 2026) — A fatal crash involving a passenger vehicle and a semi-truck occurred Sunday afternoon on Highway 97 near milepost 220. According to Oregon State Police, troopers responded around 3:45 p.m. to a collision that happened near the scene of an earlier, non-injury crash involving multiple vehicles.

Investigators reported that a northbound Kia Forte approached the earlier crash scene and then allegedly crossed the center line into the southbound lane, where it collided head-on with a semi-truck. The truck was alleged to be in the process of moving toward the shoulder to avoid a disabled vehicle from the earlier incident. After the impact, the Kia spun back across the roadway and came to rest off the northbound shoulder. The driver of the Kia was pronounced deceased at the scene. The semi-truck driver was not injured. Authorities have stated that the investigation is ongoing.

A Chain of Events Leading Up to the Collision

This crash did not happen in isolation. It occurred in the middle of an already developing situation involving an earlier collision and a disabled vehicle on the roadway. That context will be important as investigators work to understand how each driver responded to changing conditions.

When drivers encounter an unexpected hazard, such as a disabled vehicle or an earlier crash, they are expected to react in a way that a reasonable person would under similar circumstances. That may include slowing down, maintaining lane control, and avoiding sudden or unsafe maneuvers.

Applying the “Reasonable Person” Standard

In cases like this, investigators often consider whether each driver’s actions were reasonable given what they knew at the time. For the driver of the Kia, the key question may be why the vehicle crossed the center line and whether there was time and space to respond differently.

For the semi-truck driver, investigators may examine the decision to move toward the shoulder. That type of maneuver is often intended to avoid danger, but it still must be done in a way that does not create additional risk for other drivers.

Looking at both perspectives is important. Even when one action appears to set a crash in motion, the full picture often depends on how each driver reacted in the seconds leading up to the collision.

Multiple Factors May Be Involved

Because this crash involved an earlier incident, a disabled vehicle, and two drivers reacting simultaneously, there may be several contributing factors. Investigators will likely review vehicle positions, timing, and whether either driver had a clear path to avoid the crash.

They may also examine whether traffic conditions, visibility, or roadway layout played a role. In complex crashes like this, it is rarely just one decision that explains the outcome.

Why a Complete Investigation Is Critical

When multiple events overlap, it becomes especially important to avoid drawing conclusions too quickly. A full investigation will help determine how the situation developed, what each driver could reasonably see and do, and whether any actions contributed to the crash.

Reviewing physical evidence, vehicle damage, and any available data will be key to understanding how this happened and where responsibility may lie.

Experience Handling Complex Truck Crash Cases

Crashes like this involve more than a single moment of impact. They require a detailed analysis of how drivers responded to changing conditions and whether those responses were reasonable under the circumstances.

Because of that, it is important to work with an attorney who understands how to evaluate complex, multi-factor crashes involving commercial vehicles. Attorneys certified by the National Board of Trial Advocacy in truck accident law have demonstrated experience handling these types of cases, and few attorneys in the Pacific Northwest hold that certification. Tom D’Amore, founder of D’Amore Law Group, has more than 30 years of experience and is certified by the National Board of Trial Advocacy.
