How Long Do I Have to File an Ashland Personal Injury Lawsuit?
If you suffered injuries in any type of accident, it is crucial that you act quickly to bring a case. Under Oregon state law, you have just two years to bring a claim against any of the parties responsible for your injuries. If you do not bring your case within the two-year statute of limitations, the court will almost certainly dismiss your case, leaving you with no way to recover for your injuries.
However, there are three exceptions to the two-year statute of limitations.
Minors – If a person under 18 years old is hurt in an accident, they may have until they turn 19 to bring their claim. However, in no event can a minor bring a claim more than five years from the date of the accident.
Certain Disabilities – If an accident victim suffers from a “disabling mental condition” that prevents them from understanding their rights, they have up to one year from the time they can appreciate their rights. However, regardless of the length of a disability, an accident victim cannot file a claim more than five years from the date of the accident.
Absent Defendant – If the would-be defendant leaves Oregon or takes any step to conceal their identity after the accident but, before being served with the lawsuit, this time will not count towards the statute of limitations.
While two years sounds like a generous amount of time to file a case, the deadline approaches quickly. Additionally, evidence is easier to obtain soon after an accident. For example, waiting to file your claim can make it harder to find physical evidence and locate witnesses. Not to mention, as time passes, a witness’s memory of the accident may fade. Thus, it is best to reach out to a dedicated Ashland personal injury attorney as soon as possible to discuss your options.
